Q. I am currently engaged to a soldier. He is stationed in Texas and I live in our home state of Kentucky. Since we are getting married does this mean I can legally terminate my lease? In other words if I get married to someone in the military, can my lease be terminated?
A. First, congratulations on your upcoming wedding! As for your question, I am going to assume you are the only one on the lease since you did not specify otherwise. I am going to also assume you are asking if breaking your lease would fall under the Servicemembers Civil Relief Act due to the way you worded the question.
The answer is no, you would not be protected under the SCRA due to the fact that it only protects the service member, not a dependent, girlfriend, boyfriend, mom, dad, etc… Additionally, the servicemember would have to be listed on the lease BEFORE receiving orders to PCS or deploy.
The best thing to do is to talk to your landlord or property management company and explain the situation. They may allow you to terminate the lease with a fee or sub lease the property until your lease is up.
